APPEAL TO REGULATORS

  • Special Use Permits are intended to constrain operations so that they do not cause harm to residents and the environment.  Here, the expired Special Use Permit has failed to achieve that goal.  Any existing, material and harmful deviation from prior approvals MUST be remedied.

  • The Shipyard has materially deviated from its permitted plans, which we believe has caused significant harm to countless constituents including residents, wildlife, the environment, school children, neighboring communities, and visitors

  • North River Shipyard has a record of operating without regard for local residents and the environment.  Its response to reasonable efforts to mitigate its impact has been to file lawsuits against the Village

  • North River Shipyard is expected to file its 2023 Special Permit Application by April 1, 2023.  Upper Nyack has the opportunity to thoroughly clarify permissible operating activities and establish enforceable operating and development safeguards which should be in the best interest of all its constituents

  • It is our desire that all affiliated regulators will review the Shipyard's activities versus prior permits and/or unpermitted activities: New York State, Army Corps of Engineers, Department of Environmental Conservation, Environmental Protection Agency, U.S. Coast Guard
